GENERAL TERMS AND CONDITIONS OF SERVICES PROVIDED BY UNLIMITED LUXURY RESORTS

INTRODUCTION
The following provisions represent the general terms and conditions of the services provided by UNLIMITED LUXURY RESORTS, doing business as UNLIMITED LUXURY RESORTS & CARIBE TODO INCLUIDO (hereinafter the "Terms and Conditions"):
UNLIMITED LUXURY RESORTS is a company incorporated under US law, with its registered address at at 2035 Sunset Lake Road, Newark, Delaware 19702 and a local office at 2424 S 315TH LN Federal Way, WA 98003.
By accepting these Terms and Conditions, the User, who for the purposes hereof will be referred to as the "Client", confirms that they are at least 30 years old, that they are fully aware of the content of this document, and that they accept its content in its entirety, without reservation, in the terms set forth herein.
Acceptance of these Terms and Conditions is voluntary, however, it is absolutely necessary for any person to be able to purchase the services offered by UNLIMITED LUXURY RESORTS.
UNLIMITED LUXURY RESORTS reserves the right to update or modify these Terms and Conditions at any time, and it shall be the Client's obligation to keep abreast of such modifications. The most up-to-date version will always be found on the website https://www.caribetodoincluido.com/
The services offered by UNLIMITED LUXURY RESORTS are not the property of UNLIMITED LUXURY RESORTS, nor are the resorts, hotel brands, airlines, car rental companies, banking institutions, or any other entity that is not UNLIMITED LUXURY RESORTS. The sole party responsible for such products and services is the provider.
PRODUCTS AND SERVICES
UNLIMITED LUXURY RESORTS offers, promotes, markets, and publishes various travel products and services, as referred to in its Corporate Purpose, which are not owned or operated by UNLIMITED LUXURY RESORTS.
Such services may include, but are not limited to, travel packages, travel certificates, electronic tickets exchangeable for travel, electronic travel or travel product vouchers, prepaid or payable reservations, special invitations, special events, as well as any other type or format of product or service related to travel, tourism, gastronomy, entertainment, and the like.
In any case, UNLIMITED LUXURY RESORTS provides the detailed information of said product and/or service and it is clarified that the responsible party is the operator, which will be defined in the terms and conditions of each of the products and services.
Depending on each of the products and/or services that the Client wishes to purchase, certain contracting requirements will apply, which, including but not limited to, may be: nationality, age, marital status, monthly income, level of education, credit report, liquidity, among others.
The Client must be aware of the specifications of each of the services before purchasing them, since in most cases they are not refundable and will be subject to validity periods and other requirements.
It is absolutely clear that UNLIMITED LUXURY RESORTS does not operate or provide the services directly, nor is it an airline, a hotel chain, a ticket agency, a car rental company, or any type of direct provider, but rather, its function lies exclusively in the marketing and sale of such products and/or services.
As mentioned above, each of the services will have different operating rules for contracting, which may change at any time, and which UNLIMITED LUXURY RESORTS will provide to the Client with the current conditions in force.
The terms and conditions of each of the services will establish the scope thereof, it being understood that everything that is not included is excluded. The party responsible for the content of said terms and conditions of service is the provider or operator, and UNLIMITED LUXURY RESORTS shall have no responsibility, nor does it assume any obligation with respect to the characteristics, scope, inclusions and/or limitations of said products and services.
Once the client has paid for their vacation service, they will receive a payment receipt via email and, within a maximum of 5 business days, depending on the case, the reservation code that covers their stay at the hotel.
PROMOTION AND SALES CHANNELS
UNLIMITED LUXURY RESORTS uses various channels for the promotion and sale of the aforementioned products and services, which may include, but are not limited to: by telephone, through social networks, through the Website, through Kiosks in shopping centers or public spaces, in our offices, in special and temporary campaigns in business centers, hotels, clubs, sports, shopping centers, meeting centers, restaurants, event halls, businesses, squares, and any other similar.
Likewise, we have different alliances through companies, businesses and/or independent groups, as well as through our Affiliate Program. In these cases, it is essential that the purchase be made through the channels provided for this purpose, to avoid any fraud or misuse of information. It is the Client's responsibility to verify that the promotion and/or sales channel is authorized by UNLIMITED LUXURY RESORTS.
UNLIMITED LUXURY RESORTS is not responsible for any purchase or payment made in cash, or that is not made through the payment process referred to in this document, or by any means or channel other than the channels authorized by UNLIMITED LUXURY RESORTS.
PRICES
The prices for the products or services referred to above will be those published in the terms and conditions of each of the products and/or services, which are subject to change without notice, so the Client must verify before making any purchase.
In advertising materials where prices may appear in dollars or any other currency, it is the Client's responsibility to confirm the amount to be charged prior to making payment to avoid any misunderstanding.
In all cases, prices will have specific conditions and restrictions, so the Client cannot and should not assume or presuppose any obligation on the part of UNLIMITED LUXURY RESORTS or on the part of the provider or operator of said product or service. Our promotional prices include taxes; in the case of adding minors or extra adults, the corresponding charge will be made.
Additional charges may apply to all services, so the Client is obligated to check with UNLIMITED LUXURY RESORTS and with the provider of said service to avoid any problem related to price variations.
PAYMENTS
For payments made by credit and debit cards, we use authorized and globally recognized providers, such as Mercado Pago, Paypal, dLocalGo or Billpocket as our main payment gateway provider. Also digital wallets le Google Pay, Meta Pay and Apple Pay. Likewise, it will be the Client's sole responsibility to read and understand each and every one of the policies or what is established in the portal. The conditions of use may be subject to modification, so it is recommended to read them periodically, in addition to the terms and conditions shown for the correct use of the payment gateways.
Under no circumstances will there be a refund of the payment, even if there is an error in the purchase or in the transaction, and in any case a change or bonus may be made, only when the provider or operator of the service allows it.
For the purposes hereof, any Member of the Affiliate Program is not considered to be a sales representative of UNLIMITED LUXURY RESORTS and may not receive any payment by any means.
As has been made clear above, payments are received directly by the provider or operator of the product and/or service, or by UNLIMITED LUXURY RESORTS when authorized. IN NO EVENT may payments be received by the sales channels, by the sellers, by the Members of the Affiliate program, or by any other natural or legal person, and UNLIMITED LUXURY RESORTS will not be responsible for any payment made in a manner other than the authorized process referred to in this section.
CHANGES
As a general rule, no changes or refunds will apply, except when the terms and conditions of the products and/or services so provide, as long as the providers or operators of these authorize it.
UNLIMITED LUXURY RESORTS will not be responsible for making any type of change, nor for processing any refund. However, it may make available to Clients the customer service mechanism it deems appropriate, and to which it refers below.
BRANDS
No Client assumes any right over the brands and names of any of the providers or Operators of the Travel Products, nor of any hotel, hotel group, car rental company, or any other party involved in the Travel Product.
Therefore, the Client may not use the brands, names or advertising of these, nor may they request any authorization, much less attempt to carry out the registration of these.
Likewise, no Client may use the name of UNLIMITED LUXURY RESORTS, nor its image, nor its trademarks, for any purpose.
The Client undertakes to refrain from making and urging other persons to make comments in person and/or on social networks, forums, travel pages, groups and other similar, that are negative or that denote or that affect in any way UNLIMITED LUXURY RESORTS, its Suppliers, Allies, Contractors, Partners, or any other natural or legal person that has any relationship with UNLIMITED LUXURY RESORTS, the hotels, the restaurants, the car rental companies, or any natural or legal person that is directly or indirectly related to the products or services referred to herein.
COMPLAINTS, CLAIMS, AND REQUESTS
If you have any complaints, claims, or requests about UNLIMITED LUXURY RESORTS or any related travel product or service, please address them directly to us. We will not handle any issues raised with other individuals or entities.
UNLIMITED LUXURY RESORTS will assist you in managing any complaints, claims, and/or requests you may have. We will inform you of the outcome, which you must accept regardless of the resolution.

If you purchase any product or service directly from any individual or entity other than UNLIMITED LUXURY RESORTS, we are not responsible for it, and any complaints or claims will not be handled by us.
CONTRACTING AND USE CONDITIONS
As mentioned earlier, each service will have specific contracting and use conditions, which the Client must be aware of and comply with, and which are completely independent of UNLIMITED LUXURY RESORTS; however, UNLIMITED LUXURY RESORTS will provide all the required information.
In the event that the Client does not comply with said conditions, the provider or operator of the services may establish penalties, charge additional fees, invalidate discounts or preferential rates, and even deny, limit or cancel the services, either totally or partially.
Due to the foregoing, it is essential that the Client is aware of these requirements, as at no time may they claim ignorance as a cause or reason to request any refund or require any compensation.
APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by applicable Mexican law. To resolve any dispute or conflict arising from these Terms and Conditions, the parties submit to the jurisdiction of the courts of Mexico City, even if the domicile of these or any other interested party is in a place other than Mexico City or even abroad.
USE OF CERTIFICATES (MINIVACS)
This Certificate is valid for the number of days and nights selected and indicated in the description of each hotel service on the online page:
- Maximum purchase of 1 certificate per family or holder.
GENERAL CONDITIONS
- After your online payment, this Certificate is not valid if it is not activated. To activate the Certificate, you must contact the Contact Center at +52(55)30001772 (MEX Direct) or our US Number +12537859776 . Once the Certificate is activated, it will be available to book and travel subject to availability.
- The use of this Certificate is in one single exhibition.
- The validity of use of the Certificate is 6 months from the date of purchase. Therefore, its use must be completed within this period.
- Reservations must be made through the Contact Center at least fifteen calendar days before the date on which you wish to redeem this Certificate.
- The persons who will use this Certificate will have to comply with predetermined qualification requirements and attend a mandatory 120-minute sales presentation (the "Vacation Club Presentation"), as well as sign and deliver the corresponding acceptance agreement prior to confirmation of the accommodation reservation.
- In case of not attending the Sales Presentation, the current public rate (rack rate) will be charged at the time of check-out. The Vacation Club reserves the right to block the suite until said penalty payment is made for not complying with the terms and conditions.
- All amounts are expressed in US dollars, but may be payable in Mexican pesos at the exchange rate in effect on the day the payment is made and as published by UNLIMITED LUXURY RESORTS and indicated by the Contact Center.
- Amounts paid for deposit and activation are non-refundable.
- The remaining balance of the total amount to be paid for the certificate after the deposit has been paid must be paid at the time of Activation within a maximum period of 90 days after the date of purchase.
- Change Policy: You can make one and only one change of dates and/or hotel in your reservation without penalty as long as the change is requested at least 30 days before your arrival date at the Hotel. Any additional changes 29 days after your scheduled arrival date will have a "change fee" of $250.00 US dollars, legal tender in the United States of America or its equivalent in National Currency at the current exchange rate published by UNLIMITED LUXURY RESORTS. All change requests are subject to room availability at the Hotel.
- This Certificate does not include or cover any other service, charge or expense such as airfares, taxes, transportation, tours, golf fees, personal expenses, security deposits and/or any other related expense.
- This Certificate is not valid during holidays and festive weeks such as Christmas, New Year's, Holy Week and Easter Week.
- All accommodation reservations are subject to availability and space.
- The hotel service sponsored by the Vacation Club must be used on the first day of arrival at the chosen destination. This Certificate cannot be used in conjunction with any other similar promotion or with other travel agency service.
- Each of the participating hotels has different admission policies and are the sole responsibility of each of the hotels. It is the Client's responsibility to consult the admission policies and characteristics of the participating hotels.
